General Terms and Conditions and Operational Rules
regarding accommodation in the Psí bouda apartments, at the address Štěpanická Lhota 53, Benecko, 514 01 (hereinafter referred to as “General Conditions”).
1.1. All provisions of these General Conditions become an integral part of every obligatory relationship between the company Wid Real Estates s r.o., ID No. 27941400, with its registered office at Rybná 716/24, Prague 1, 110 00, registered in the Commercial Register maintained by the Regional Court in Prague, Section C, Insert 128118, operator of Psí bouda on one side and a natural person or legal entity that concludes a contract for accommodation with the Accommodator as a guest or representative of the guest (in case of a legal entity) (hereinafter referred to as "Guest") on the other side. All persons accommodated together with the Guest or for whom the Guest concludes a contract for accommodation with the Accommodator are considered to be Guests.
1.2. These General Conditions regulate the accommodation of Guests by the Accommodator, based on a contract or agreement on accommodation concluded between the Accommodator and the Guest. A reservation made by the Guest through the reservation system and accepted by the Accommodator is considered a contract or agreement on accommodation under these General Conditions.
1.3. By making a reservation through the Accommodator's reservation system, the Guest expresses full consent with all rights and obligations contained in these General Conditions and arising from these General Conditions.
2.1. The Guest has the right, unless the Accommodator offers a different time for accommodation, to move into the rented premises from 15.00 hrs. on the agreed day (“day of arrival”).
2.2. On the day of departure, the Guest must vacate the rented premises by 10.00 hrs. at the latest (hereinafter referred to as “day of departure”). The Accommodator is entitled to charge another day if the rented premises are not vacated by the Guest on time.
3.1. The Guest is obliged to pay the price for accommodation and other services according to the current price list of the Accommodator on the day of arrival. The price list is available in the reservation system. The price for the apartment includes stay, towels, bed linen. The price does not include final cleaning and a recreational fee of 25, - per adult and night.
3.2. Prices are stated in CZK. The Accommodator is not a VAT payer.
3.3. Payment in a currency other than CZK is possible by agreement with the Accommodator.
3.4. The Guest is obliged to pay a deposit of 30% of the total price of the stay within the deadline set by the Accommodator to the Accommodator's account. Information for making a deposit payment will be stated on the deposit invoice.
3.5. In the event that the deposit is not paid by the Guest within the deadline set by the Accommodator, the Accommodator is entitled to withdraw from the contract and the agreement on accommodation with immediate effect and cancel the reservation. Withdrawal does not terminate the right of the Accommodator to compensation for damages and other performances under these General Conditions.
3.6. The deposit is a partial payment of the agreed remuneration.
3.7. The Guest acknowledges that by concluding a contract or agreement on accommodation and paying a deposit of 30% of the total price of accommodation, the Accommodator reserves for the Guest the accommodation capacity requested by him.
3.8. The Guest is obliged to pay the balance of 70% of the total price of accommodation fourteen (14) days before the day of arrival. If the Guest does not pay the balance within the specified deadline of fourteen (14) days before the day of commencement of accommodation, the Accommodator has the right to cancel the reservation without the Guest's right to a refund of the deposit and offer this term for reservation to other guests.
3.9. The Guest has the right to cancel the reservation free of charge no later than the thirtieth (30) day before the start of the stay. The paid deposit of 30% will be refunded to the account from which it was sent within ten (10) days from the cancellation of the stay.
3.10. The Accommodator is entitled to offset the cancellation fee with the deposit paid by the Guest.
3.11. If the Guest departs early, the Accommodator is entitled to demand the full agreed price for the entire duration of the guest's stay.
4.1. The Guest is entitled to use the rented premises and the accommodation facility's equipment, which guests can commonly use without any special conditions, in a customary manner during the stay.
4.2. The Guest is obliged to abide by the House Rules throughout the stay at the Accommodator's, which are part of the reservation.
4.3. The Guest is obliged to behave in such a manner as not to disturb other accommodated guests.
4.4. The Guest is liable to the Accommodator for any damage caused by themselves, other persons who knowingly or willingly use the Accommodator's services, and for damage caused by animals brought by them.
4.5. The Guest is obliged to ensure that the animal brought by them does not soil the equipment and furniture (especially upholstered). If the animal is accustomed to sleeping in the bed or on the couch, it is recommended to bring own protective covers for furniture protection. In case of contamination with mud, urine, or an excessive amount of hair, a fee of 1,500 will be charged for cleaning each soiled piece of furniture by an external cleaning company.
4.6. The entire object Dog hut is strictly non-smoking. Smoking is also prohibited on balconies and in common outdoor areas. In case of violation of this ban, a fine of 5,000 CZK (five thousand Czech crowns) will be charged to the Guest. In case of repeated violation of this ban, the Guest's stay may be terminated without a claim for a refund of the accommodation fee.
5.1. The Accommodator is obliged to provide the Guest with agreed services in the agreed extent, in a customary manner.
6.1. The Accommodator is not liable for any damage to jewels, money, and other valuables brought into the Accommodator's premises.
6.2. The Accommodator is liable for damage to other brought-in items in the manner set out by the Civil Code in its valid wording.
7.1. Animals are allowed to stay in the accommodation facility free of charge. Their number, type, and breed must be reported by the Guest when booking the stay.
7.2. The Guest, who has an animal with them, is obliged to take proper care of this animal during their stay.
7.3. The Guest is liable for all damages caused by the animals brought by them, both to the property of the Accommodator and to the property of other accommodated Guests.
7.4. The Guest undertakes that the animals brought by them will not disturb other accommodated guests with noise or unwanted contact. In particular, they are obliged to ensure that the animal left alone in the apartment will not bark and will have the dog on a leash or under control in common areas so that the dog cannot seek contact with another accommodated dog unless both agree explicitly with the contact of dogs.
8.1. The place of performance is the location of the Accommodator's accommodation facility.
8.2. The rights and obligations of the contracting parties are governed by the legal order of the Czech Republic, in particular by Act No. 89/2012 Coll., the Civil Code, as amended.
8.3. The contracting parties undertake to resolve any disputes arising from or in connection with the accommodation agreement principally amicably. The contracting parties further agree that if they do not resolve any dispute or claim arising from the accommodation agreement amicably, the general court of the Accommodator will be competent for resolving disputes.
