Payment options

Online payments are provided for us by the ComGate Payment Gateway. Service provider, ComGate Payments, a.s. is a licensed Payment Institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured and all information is encrypted.

Credit card payment

The fastest way to pay online. In the ComGate Payment Gateway interface, you enter the card number, validity date and CVC code - three numbers that you can find in the signature strip on the back of the card. Everything is secured by the 3D Secure standard, so you will probably be asked to enter a numerical code that you will receive by SMS from your bank.

Payment by bank transfer

Instant payment via internet banking. The ComGate payment gateway redirects you to your internet banking, where you log in as usual and confirm the already prepared payment order.

General Provisions

The company EBA Park, s.r.o., Company ID No. 07060246 (hereinafter referred to as the “Accommodation Provider”), hereby issues these GENERAL TERMS AND CONDITIONS (hereinafter referred to as the “GTC”) pursuant to Section 1751 of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the “Civil Code”).

These GTC govern the conditions under which accommodation and related services are provided to customers (hereinafter referred to as the “Client”). The GTC form an integral part of all agreements between the Accommodation Provider and the Client. By confirming the Accommodation Provider’s offer or by making a reservation (hereinafter referred to as the “Reservation”), the Client acknowledges and agrees that these GTC are binding for all services provided.


Reservation of Services

Accommodation at APARTMENT Horní Mísečky may be booked exclusively in written form (by post, email, or by completing and submitting the online form on the Accommodation Provider’s website). Reservations may also be made by telephone; however, in such cases the reservation shall be considered accepted only upon written confirmation.

A contractual relationship is established upon submission of the service order and proof of payment of the deposit. The Client is responsible for the accuracy of the information provided in the reservation. Any changes, especially changes in the number of guests, must be reported to the Accommodation Provider without undue delay.

A reservation may be made by the Client for themselves or on behalf of a third party. The Accommodation Provider shall confirm the reservation in writing by email or post. The reservation (order) must include:

  • Client’s full name

  • Date of stay

  • Client’s contact details: telephone number, permanent address, email

  • Method of payment

  • Number of guests, specifying adults and children (including children’s ages)

Preliminary reservations are usually processed within 24 hours. The Accommodation Provider may confirm the preliminary reservation, set an option, reject the reservation, or propose an alternative date.

A reservation becomes binding upon written confirmation by the Accommodation Provider. The Client is obliged to review the confirmation and report any discrepancies within 24 hours.

The reservation is binding. The scope of services and prices agreed upon is defined exclusively by the reservation confirmation.


Payment Terms

A deposit of 50% of the accommodation price must be paid no later than 3 days after the reservation is created. Payment of the deposit means crediting the relevant amount to the Accommodation Provider’s bank account, unless otherwise agreed. If the deposit is not paid properly and on time, the Accommodation Provider reserves the right to cancel the reservation and charge cancellation fees pursuant to Article 6 of these GTC.

The Client may pay the accommodation price and deposit:

  • by payment card via the online payment gateway on the Accommodation Provider’s website, or

  • by bank transfer to the Accommodation Provider’s account, or

  • exceptionally, by cash upon prior written agreement, against a receipt.

Prices do not include local accommodation or spa fees, which are charged according to the applicable municipal ordinance.

The remaining balance must be paid no later than 30 days before the start of the stay, unless otherwise agreed in writing.

If the stay is booked less than 30 days before arrival, the full amount must be paid immediately.

If the Client is more than 5 days late with any payment, the Accommodation Provider has the right to cancel the confirmed reservation and charge interest on late payment at a rate of 0.5% of the outstanding amount per each commenced day of delay. The Accommodation Provider may apply any payment received from the Client to settle the Client’s oldest outstanding debt.


Rights and Obligations of the Client

The Client has the right to use the assigned apartment for the agreed period. Check-in takes place between 3:00 PM and 8:00 PM, unless otherwise agreed in writing. Upon prior written agreement, late check-in between 8:00 PM and midnight is possible for a fee of CZK 300.

Check-out must take place no later than 10:00 AM on the day of departure.

The apartment and its furnishings shall be handed over in accordance with the Inventory List, which is available in the building. All listed items shall be functional and undamaged, which both parties confirm by signature. Any missing, damaged, or non-functional items identified upon check-out must be paid for by the Client in cash. A security deposit of CZK 5,000 is required upon check-in. If damage exceeds this amount and no immediate agreement is reached, the matter will be reported to the Police of the Czech Republic.

Smoking is strictly prohibited throughout the entire building. In the event of a violation, the Accommodation Provider is entitled to immediately evict the Client and all accompanying persons without compensation. The Accommodation Provider may carry out random inspections of the apartment during the stay.

The Client must treat the Accommodation Provider’s property with care and immediately report any damage or defect. The Client is responsible for maintaining cleanliness and order in the apartment, ski storage room, and common areas. Quiet hours apply from 10:00 PM to 6:00 AM.

The Client is responsible for safeguarding their personal belongings. The Accommodation Provider does not insure these items and bears no liability for their loss.

Complaints must be submitted without undue delay during the stay so that corrective action may be taken. Complaints made after the stay will not be accepted. A written record of the complaint must be created and signed by both parties.

The Client is required to take over keys and access chips upon arrival. Loss of keys or chips must be reported immediately. The Client shall bear all costs related to replacement.

The Client is responsible for all visitors and must accompany them in common areas. The Accommodation Provider reserves the right to deny access to or expel unauthorized persons.

The Client is liable for all damage caused by themselves, their guests, or any persons acting with their consent.

Upon departure, the Client must return the apartment in the same condition, including basic cleaning, emptying the dishwasher, and disposing of trash. Failure to do so may result in a fine of up to CZK 1,000, unless cleaning services were ordered in advance.

If the Client fails to vacate the apartment on time, the Accommodation Provider may charge an additional night or remove and store the Client’s belongings at the Client’s expense.


Prohibited Activities

The Client is strictly prohibited from:

  • allowing third parties to stay overnight or lending keys,

  • rearranging furniture without consent,

  • smoking anywhere in the building,

  • tampering with electrical, water, data, or heating systems,

  • using higher-wattage light bulbs,

  • bringing hazardous items, weapons, drugs (including marijuana), gas or electric heating appliances,

  • modifying door locks,

  • keeping animals of any kind,

  • throwing objects or liquids out of windows.

Violation of these rules may result in a fine of up to CZK 5,000 or immediate termination of accommodation without refund.


Rights and Obligations of the Accommodation Provider

The Accommodation Provider may offer alternative accommodation of comparable standard if necessary.

The Accommodation Provider may invoice services at any time.

If the Client leaves earlier than agreed, the full price remains payable.

The Accommodation Provider may terminate the contract immediately without refund if the Client damages property, behaves inappropriately, endangers others, or due to force majeure.


Insurance

The apartment is insured against standard risks (e.g. fire). Insurance does not cover damage caused by the Client or personal injury. Clients are advised to arrange their own travel and liability insurance.


Cancellation Policy

Cancellation fees apply as follows:

  • 50% of the total stay price if cancelled more than 60 days before arrival,

  • 100% of the total stay price if cancelled less than 14 days before arrival.


Personal Data

By submitting a reservation, the Client consents to the processing of personal data for accommodation records, accounting purposes, and the Accommodation Provider’s own marketing. Personal data will not be shared with third parties.


Final Provisions

These GTC form an integral part of the accommodation reservation and are available at
https://apartmanhornimisecky.eu/.
The GTC are effective as of 1 May 2020. Any amendments must be made in writing.

If the Client withdraws from the concluded contract, he is obliged to pay the operator the cancellation fees listed below from the total price of the stay.

Cancellation fees are:

30% of the price of the stay, if the contract is canceled more than 45 days before the agreed start date of the stay,
70% of the price of the stay, if the contract is withdrawn from 45-14 days before the agreed start date of the stay,
100% of the price of the stay, if the contract is canceled less than 14 days before the agreed start date of the stay.

Klient odesláním vyplněné objednávky emailem potvrzuje svůj souhlas s manipulací s jeho osobními daty pro účely evidence ubytovaných, dále pro účely účetnictví ve smyslu daňových zákonů ČR a pro účely vlastního marketingu. Pronajímatel se zároveň zavazuje, že neposkytne osobní údaje nájemce třetí straně.
