General terms and conditions for short-term and long-term rental of the Chalet Ferrata Martinky.
1. General provisions
The provider's services are mainly short-term and long-term rental of a cottage for the client. The subject of the contract is to ensure the client's stay within the agreed date and scope.
Only the reported number of people can be accommodated, any increase in the number of people must be reported in advance and paid for.
The client is responsible for damage to the equipment caused by him or by persons using the cottage together with him. All damage caused intentionally or through negligence is considered destruction of property and the client is obliged to pay for all resulting damage.
The client is obliged to immediately report defects or deficiencies that occurred in the cottage premises or on the adjacent land.
When reporting damage, 100% of the price is charged. In the event of intentional concealment, 200% of the price is charged. If the client does not pay the agreed amount, the intermediary will transfer the claim to a third party who is authorized to represent the intermediary.
The client undertakes to pay all costs incurred due to damage to the cottage equipment caused by him or the persons who used the cottage with him.
After the end of the lease, the tenant undertakes to hand over the cottage in the condition in which he received it.
In case of an accident, injury to health or other unforeseen circumstances, the landlord or his representative shall not be liable.
Smoking is prohibited in all areas of the cottage. Smoking is permitted outside the cottage and guests are required to clean up after themselves.
Quiet hours are from 10:00 p.m. to 6:00 a.m.
The client may not make any changes or repairs to electrical equipment or otherwise interfere with the electrical installation in the entire cottage and its surroundings.
The provider reserves the right to immediately terminate the stay if the client violates these General Terms and Conditions for Stay or has caused significant damage to the cottage and its facilities or if the behavior of the client and the persons using the cottage with him is indecent.
The operator of the Ferrata Martinky Cottage reserves the right to not allow further stays to clients who have previously engaged in the aforementioned behavior.
By paying the deposit, the client accepts the cancellation conditions and confirms that he is familiar with these General Terms and Conditions for Stay, understands them, agrees with them and accepts them in full.
2. Time frame
The contractual relationship between the provider and the user is established by the confirmation of the telephone order or order form by the lessor and the payment of the full amount for the accommodation by the lessee (client). The contractual relationship ends after the agreed period for which the stay was booked has expired.
3. Ordering
The client can book his stay directly via the website:

Or via partner websites such as Booking.com...
In the case of an order made in this way, the provider undertakes to notify the client within 3 days of acceptance of his order and reservation of the cottage, which is binding on the lessor only after the full amount has been paid and credited to the lessor's account. The rental period is set at a minimum of two nights or more.
4. Rental price
The resulting rental price is based on the client's requirements and according to the valid price list, which is published on the website:

5. Payment terms
The full amount of the stay must be paid within 3 days of the landlord's confirmation of the requested date.
Only after receiving the payment to the landlord's account is the reservation binding for both parties.
The accommodation price includes all fees for using the cottage except for the local accommodation tax (2€/night/person).
The client will pay a refundable deposit of 200€ for the cottage when paying for the stay by transferring money to the account and after the cottage is handed over without damage, the deposit will be returned to the bank account within 48 hours of the end of the stay.
6. Rights and obligations of the client and the provider
The client is obliged to pay the rental fee.
The client is obliged to maintain cleanliness and order.
The client has the right to use the rented premises, basin, garden grill, reserved parking spaces.
If it is a legal entity, notify the authorized person.
7. Client insurance is not included in the accommodation price.
8. Cancellation of the order
a) In case that the order is cancelled by the client, the rental provider is entitled to a cancellation fee.
The amount of the cancellation fee is:
– more than 30 days before the start of the stay – 30% of the total price of the stay
– less than 30 days (inclusive) – 50% of the total price of the stay
– early termination of the stay – 80% of the price of the remaining days, unless otherwise agreed.
– one week before the start of the accommodation 100% of the total price of the accommodation.
b) The provider reserves the right to cancel the reservation if the rental object is not capable of use due to unforeseen events. In such acase, he may offer the client a full refund of the amount paid, or agree on an alternative date.
c) Further changes to the order (date change) will be considered a cancellation of the order and in this case the rental provider is entitled to a cancellation fee.
9. Complaints conditions
In case that the scope or quality of the stay services are at a lower level than agreed and specified in the offer, the client has the right to complain. During the stay, damages and property damage are not considered as the subject of the complaint, which are expressly excluded within the scope of insurance coverage.
The further procedure of the complaint procedure is governed by the complaints procedure in accordance with the legislation of the Slovak Republic.

Storno Podmienky
a) V prípade, že dôjde k zrušeniu objednávky zo strany klienta má poskytovateľ prenájmu právo na storno poplatok.
Výška storno poplatku je:
– viac ako 30 dní pred začiatkom pobytu – 30% z celkovej ceny pobytu
– menej ako 30 dní (vrátane) – 50% z celkovej sumy pobytu
– predčasné ukončenie pobytu – 80% z ceny ostávajúcich dní, ak nie je dohodnuté inak.
– týždeň pred nástupom na ubytovanie 100% z celkovej ceny ubytovania.
b) Poskytovateľ si vyhradzuje právo zrušiť rezerváciu v prípade, ak by nebol predmet prenájmu vplyvom nepredvídateľných udalostí schopný užívania. V takomto prípade môže ponúknuť klientovi vrátenie poukázanej sumy v plnom rozsahu, resp. sa dohodnúť na náhradnom termíne.
c) Ďalšie zmeny objednávky (zmena termínu) budú považované za zrušenie objednávky a v tom prípade má poskytovateľ prenájmu právo na storno poplatok.

Zákonný dôvod a účel spracúvania osobných údajov
Zákonným dôvodom spracúvania osobných údajov je Váš súhlas týmto daný správcovi v zmysle čl. 6 ods. 1 písm. a Nariadenia Európskeho parlamentu a Rady č. 2016/679 o ochrane fyzických osôb v súvislosti so spracúvaním osobných údajov a o voľnom pohybe týchto údajov a o zrušení smernice č. 95/46/ES (všeobecné nariadenie o ochrane osobných údajov), ďalej len „nariadenie“.

Vybavenie Vašej objednávky a výkon práva a povinností vyplývajúcich zo zmluvného vzťahu medzi Vami a správcom; pri objednávke sú vyžadované osobné údaje, ktoré sú potrebné pre úspešné vybavenie objednávky (meno, priezvisko, adresa, kontaktná emailová adresa, telefón), poskytnutie osobných údajov je nutnou požiadavkou pre uzavretie a plnenie kúpnej zmluvy, bez poskytnutia osobných údajov nie je možné zmluvu uzavrieť a zo strany správcu plniť.
Zasielanie obchodných oznámení (newsletterov), prípadne ďalších marketingových aktivít.
Zo strany správcu nedochádza k automatizovanému individuálnemu rozhodovaniu v zmysle čl. 22 nariadenia
Doba uchovávania údajov
Správca uchováva osobné údaje
Po dobu nevyhnutnú k výkonu práv a povinnosti vyplývajúcich zo zmluvného vzťahu medzi Vami a správcom a uplatňovania nárokov z týchto zmluvných vzťahov, t.j. po dobu 10 rokov od ukončenia zmluvného vzťahu,
Po dobu, než je odvolaný súhlas so spracovaním osobných údajov pre účely marketingu, najneskôr 10 rokov, ak sú osobné údaje spracúvané na základe súhlasu.

Správca nemá v úmysle odovzdať osobné údaje do tretej krajiny (do krajiny mimo EU) alebo medzinárodnej organizácii.
Vaše práva :
Za podmienok stanovených v nariadení máte právo požadovať od správcu prístup k Vašim osobným údajom, právo na opravu alebo výmaz Vašich osobných údajov, poprípadne o obmedzenie ich spracovania, právo vzniesť námietku proti spracúvaniu Vašich osobných údajov a právo na prenesenie Vašich osobných údajov.
Máte právo kedykoľvek odvolať súhlas so spracúvaním Vašich osobných údajov daný správcovi. Týmto však nie je dotknutá zákonnosť spracúvania Vašich osobných údajov pred takýmto odvolaním súhlasu. Váš súhlas so spracúvaním osobných údajov môžete odvolať na adrese alebo na e-maile uvedených v bode 1.
Pokiaľ by ste sa domnievali, že spracúvaním Vašich osobných údajov bolo porušené alebo je porušované nariadenie, máte právo podať sťažnosť na úrad na ochranu osobných údajov.
Nemáte povinnosť osobné údaje poskytovať. Poskytnutie Vašich osobných údajov nie je zákonnou požiadavkou.
Podmienky zabezpečenia osobných údajov
Správca prehlasuje, že prijal všetky vhodné technické opatrenia k zabezpečeniu osobných údajov.
Správca prehlasuje, že k osobným údajom majú prístup iba ním poverené osoby.
Záverečné ustanovenia
Odoslaním objednávky z internetového objednávkového formuláru potvrdzujete, že ste informovaný/á s podmienkami ochrany osobných údajov, že Váš súhlas je jednoznačný, určitý, slobodný a že podmienky ochrany osobných údajov v plnom rozsahu prijímate.
Správca je oprávnený tieto podmienky zmeniť. Novú verziu podmienok ochrany osobných údajov zverejní na svojej internetovej stránke.
