Terms and Conditions for Accommodation Services

1. General Provisions

These terms and conditions govern the relationship between the accommodation service provider, Ing. Ondřej Závodný, ID: 74453271, with registered office at Lhotka 180, 73947 Lhotka , contact person: Jaroslava Konečná, email: info@u-fandy.cz, phone: +420 605 509 409 (hereinafter referred to as the "Provider"), and the customer (hereinafter referred to as the "Customer") who reserves accommodation at the Provider's facility.

2. Reservations and Contract Conclusion

2.1. The Customer makes a reservation through the booking system available on the Provider's website.

2.2. The reservation becomes binding upon confirmation by the Provider.

3. Pricing and Payment Terms

3.1. The accommodation price is determined based on the room type, number of guests, length, and date of stay.

3.2. The booking system automatically calculates the deposit amount, which the Customer is required to pay online within three days of reservation confirmation.

3.3. If the deposit is not paid within the specified period, the Provider reserves the right to cancel the reservation and make the date available to other customers.

4. Cancellation Policy

4.1. The conditions for reservation cancellation and any applicable fees are detailed in a separate document titled "Cancellation Policy," available on the Provider's website.

5. Alternative Dispute Resolution

5.1. In the event of a consumer dispute, the Customer has the right to contact the Czech Trade Inspection Authority, located at Štěpánská 567/15, 120 00 Prague 2, website: https://adr.coi.cz/en.

5.2. For online dispute resolution, the platform available at http://ec.europa.eu/consumers/odr can be used.

6. Final Provisions

6.1. These terms and conditions are valid and effective from 1.1.2024 and form an integral part of the accommodation contract between the Provider and the Customer.

6.2. The Provider reserves the right to amend these terms at any time. The current version is always available on the Provider's website.

Cancellation Policy

1. Reservation and Payment

To confirm a reservation, a deposit of 50% of the total stay price is required, payable via online payment gateway within three days of reservation confirmation. The remaining balance is due upon arrival.

2. Reservation Cancellation and Cancellation Fees

The customer may cancel the reservation in writing or via email. The cancellation fee is determined by the time of cancellation prior to the scheduled arrival:

• More than 30 days before arrival: No cancellation fee; the deposit will be fully refunded.

• 30 to 15 days before arrival: Cancellation fee of 50% of the total stay price; equivalent to the paid deposit.

• 14 days or less before arrival: Cancellation fee of 100% of the total stay price; the deposit will not be refunded, and the customer is obligated to pay the remaining balance.

3. Long-Term Prepaid Stays

For long-term prepaid stays, the cancellation fee equals the paid deposit. The possibility of canceling the reservation is individually adjusted.

4. Method of Reservation Cancellation

Reservations can be canceled in writing or via email at info@u-fandy.cz. The date of receipt of the cancellation determines the applicable cancellation fee.

5. Deposit Refund

In cases where the customer is entitled to a deposit refund, the amount will be returned within 14 days of receiving the written cancellation.

6. Exceptions

In extraordinary circumstances, the cancellation fee may be individually adjusted upon agreement with the provider.

Personal Data Processing Policy

1. Data Controller

The data controller is WELLNESS & RESTAURANT U FANDY, located at Lhotka 180, 739 47 Kozlovice, ID: 74453271 (hereinafter referred to as the "Controller").

2. Scope of Processed Personal Data

The Controller processes the following personal data:

• First and last name
• Company name
• Email address
• Phone number
• Address

3. Purpose of Personal Data Processing

Personal data is processed for the following purposes:

• Handling accommodation inquiries
• Offering alternative services
• Facilitating accommodation arrangements
• Sending commercial communications about events and services that may interest you

4. Data Retention Period

Personal data will be processed for a period of 2 years from the date of consent.

5. Withdrawal of Consent

You may withdraw your consent to the processing of personal data at any time by sending an email to info@u-fandy.cz or by writing to the Controller's address.

6. Data Processors

Personal data may also be processed by the following processors:

• Providers of server, web, cloud, or IT services
• Business partners of the Controller
• Employees of WELLNESS & RESTAURANT U FANDY
• Other providers of processing software, services, and applications

7. Data Subject Rights

According to applicable legislation, you have the right to:

• Withdraw consent to the processing of personal data at any time
• Request information about the personal data we process about you
• Request an explanation regarding the processing of personal data
• Access your personal data and have it updated or corrected
• Request the deletion of your personal data
• In case of doubts about compliance with obligations related to personal data processing, contact us or the Office for Personal Data Protection

8. Effective Date

This policy is effective from May 25, 2018.
